About Us
We are a fully bonded Australian travel agent licensed in the state of Victoria (licence number 33009). The Kimberley Collection (‘TKC’ or ‘we’ or ‘us’), The Territory Collection (‘TTC’ or ‘we’ or ‘us’) and Luxury Kimberley Cruises (LKC) (‘LKC’ or ‘we’ or ‘us’) are trading names of Timeless Travel Collection Pty Ltd (ABN 77 142 403 754). Our trading address is Suite 4, 122 Para Rd, Montmorency, Victoria 3094.
Responsibility
Products and services are sold by TKC, TTC and LKC as an agent and wholesaler for airlines, hotels, car rental companies, tour companies, cruise operators and other suppliers providing services, including accommodation and transportation. You may also be referred to as ‘your’, ‘client’, ‘individual’, or ‘passenger’.
Separately, we cannot be held responsible for any unforeseen circumstances beyond TKC, TTC and LKC’s control (including, but not limited to, a natural disaster, health emergency or other state of emergency, or a direction declared / imposed by State or Federal Government) which results in the cancellation, postponement, alteration, delay or any other impact on your holiday.
TKC / TTC / LKC are not a provider of services and have no responsibility for services provided or not provided by any party. We give and make no warranty or representation regarding the standard of any service or product to be supplied and no person has authority to make any such representation or warranty on behalf of TKC, TTC and LKC. All tickets, coupons, exchange orders, vouchers and receipts are issued subject to the appropriate tariffs and applicable taxes and terms and conditions of sale of suppliers and these terms. They are issued by us as agent and wholesaler only. We have no responsibility, and extend no guarantees for discontinued promotions, airfares or specific holiday products. TKC, TTC and LKC acts as the agent in making these arrangements with third party suppliers. You will also be subject to the terms and conditions of any third-party suppliers in addition to our terms and conditions.
Liability
We arrange your holiday, and this will be provided by other suppliers. We sell holidays in Australia and provide you and other passengers with bookings, arrangements, ticketing and other related services.
We ourselves do not provide transport, accommodation, meals or other facilities described in our terms that you may receive on your holiday, all of which are provided by air and land carriers, cruise companies, tour operators, suppliers, and other services providers.
We have no liability for any act, omission or default, whether negligent or otherwise, of airlines, car rental operators, cruise companies, hoteliers, tour operators or any other supplier. We have no liability for any loss or damage occasioned by the negligence, act or omission of any supplier or other third party. We reserve the right to cancel or modify itineraries or bookings where circumstances require. In such circumstances, you will be notified accordingly.
In circumstances where the liability of TKC, TTC and LKC cannot be excluded, such liability is limited to the value of the purchased travel arrangements. We reserve the right to decline any booking for any individual on any tour or other service and reserve the right to apply a non-refundable itinerary preparation fee of $150 per individual to be credited fully at the time of the booking confirmation.
You will at all times indemnify and keep indemnified us and our directors, employees, officers and agents, from and against any loss or liability incurred or suffered by you or by us arising from any claim, demand, suit, action or proceeding by any person against you or us where such loss of liability arises out of, or in connection with or in respect of, your conduct in breach of these terms.
Prices and Conditions
Prices and conditions are current at the time of publication but are subject to change without notice to you. Prices are valid for travel from 1 April 23 to 31 March 24. Some operators may impose conditions that vary from the conditions stated here.
Deposits and Final Payments
A minimum non-refundable deposit of $150 per individual or up to 10% of the gross value of the booking for bookings of $3,000 and above (outside any supplier deposits) is required by TKC, TTC and LKC within seven (7) days of confirmation of your booking. Full payment of your holiday cost must be made no later than 60 days prior to the travel date. The terms and conditions of other suppliers may require payment of a further deposit and full payment earlier than 60 days prior and such payments must be made to ensure you secure your booking.
Cruise bookings can require up to a 25% non-refundable per individual deposit to be paid as confirmation of the booking and is required by the cruise operator. Full payment is required at least 120 days prior to the departure of the cruise.
All deposits are to be made within 7 days of making the booking. Bookings made within 60 days of departure will require immediate full payment. Deposits are non-refundable in the case of cancellation. Bookings cancelled once final payment has been made are subject to service charges imposed by service providers and TKC, TTC and LKC. Our fee for service charges will be a minimum $150 per individual or 10% of the total gross booking, whichever is greater.
Similarly, after travel has commenced, any refund to the client on services not utilised on the holiday may incur cancellation fees imposed by the suppliers and a fee for service charge which will be a minimum of $150 per individual and may be up to 10% of the gross value of the balance of the booking, whichever is greater.
A refund processing fee of $110 per booking for any cancelled booking is also applied.
New bookings made within 30 days of departure or with a value of $500 or less can be levied a $55 fee. Additional components required to be added to an existing booking within 60 days of departure or after final payment has been made can be levied a $55 fee.
Once a deposit payment is made for your booking, it is deemed that you have read, understood and accepted the terms and conditions for the booking. A deposit acts to hold the services requested but does not guarantee prices. If you have any queries, please contact us before making a booking for any service.
Itinerary Planning Fees, Late Bookings and Change Fees
Following the provision of our initial quote, should we be directed to proceed in planning any bookings / services and you subsequently decide to cancel this booking, we reserve the right to charge a planning fee of $150 per individual. In most cases the initial deposit of $150 per individual will be retained by us in satisfaction of this planning fee.
Should you wish to make any change to confirmed bookings, you may be subject to a change fee as follows:
- $55 per individual for rail, cruises and overnight or extended tours; or/and
- $22.00 per individual or each sector change within the booking. This change fee applies to all other This includes but is not limited to accommodation, tours, transfer, scenic flights etc.
TKC, TTC and LKC reserve the right to charge a late booking fee of $25 for any late bookings which require documents being sent via registered post, express post or courier to arrive in time for your travel.
Airfares
Any airfares that are included in your travel are subject to availability and many have special conditions that apply. Many airfares cannot be changed without significant penalties and it is your responsibility to ensure that you are aware of, and accept these conditions, prior to booking. They are available from the carriers’ own websites. Photo Identification (Driver’s License, Passport etc) must be carried by all adult passengers.
Hotel Accommodation
Unless stated otherwise all accommodation prices are based on a twin share basis.
Payment Procedure
We accept payment by cash, direct deposit and cheque. TKC, TTC and LKC also accepts payment via travel agency payment systems such as Enett. We accept personal cheques subject to clearance, for which 10 days must be allowed. TKC, TTC and LKC will not incur bank charges associated with transfers. All prices are in Australian dollars.
Visas
All overseas visitors to Australia (except for New Zealand passport holders) are required to obtain a visa prior to their arrival. This is the responsibility of the traveller.
Travel Insurance
You are strongly recommended to have adequate travel insurance for your trip. We make no representation/s or guarantee/s concerning reimbursements of monies paid by you under any insurance claim. You agree not to hold us responsible for any decision made by the insurers and or by any suppliers. This also applies to our customers with bookings on international cruises.
